Let's talk about Void Marriages.

A marriage is void if either one of the parties has another living spouse, the parties are too closely related (typical statutes say that parties cannot be related by blood), and where one of the parties is under the statutory age (usually 18) at the time of the marriage and did not get parental approval or approval of the court.

A marriage is voidable and subject to annulment based on the common law grounds of:
(1) fraudulent inducement to marry;
(2) breach of antenuptial agreement;
(3) mistake in identity; and
(4) sexual incapacity.

Before the judge will grant a motion to modify the divorce, he or she must find that there has been a significant change of circumstances and that the change would be in the best interests of the children.

A significant change of circumstances occurs if one of the former spouses has moved, if one of them has remarried, or if the income of one of the former spouses has changed significantly. These are only illustrations—there is no limit to the number or kinds of changes which might justify a petition to modify.

How are debts divided in a divorce? 🤔

When the judge divides the debts, he or she also begins with the presumption that each party will pay half of the debts.

The judge usually makes adjustments, however. In deciding on the final allocation of the debts, the judge considers which spouse has the greatest income and whether one spouse is receiving more of the marital property than the other.

In addition, if there is a debt associated with an item of property (such as a mortgage on a house or a car loan), the party which receives the item of property is usually required to pay the debt.
