New case from the 11th District in Ohio, Fordeley v. Fordeley involving prenuptial agreements.
The Court found that a premarital agreement can only be enforced if the party challenging its validity can prove that the other party entered into it with full disclosure or with their own independent knowledge of assets. In this case, the court found that the premarital agreement between the couple was invalid because the wife did not have a complete understanding of the value of her husband's businesses when she entered the agreement. The court determined that although the wife had some knowledge of the nature and extent of the businesses due to her work with them, she was only 19 years old at the time and did not fully understand their value. The need for expert testimony to value the businesses for the purpose of dividing assets further supported the court's decision.
