Frèdèric Allinne, France "I would like to share my long answer, via another famous social network, to a certain Ryan who asked me, with slight irony I guess : "Is it wrong to be prosecuted for having s*x with a minor ?"
My reply was:
"No, by US laws, it is not wrong, Ryan. But « prosecuting someone for having s*x with a minor » is not the issue here.
There's a big difference between prosecuting and torturing. There’s a big difference between prosecuting with a fair outcome, and sentencing to a sickly unfair punishment.
As for being a minor, you know that s*x is legal at 17 in the USA. And at 17.5, a young man is 95% of 18. In other words, he is 95% of an adult and 5% of a minor. Although justice is not algebra, things should be considered accordingly
Social and s*xual adulthood doesn't suddenly appear on the morning of your 18th birthday. It's a process.
A consensual and carnal love affair between a nice 100% young female adult and a sturdy 95% young male adult, is that wrong ? No. Not wrong at all.
So much so that, in Florida, you can be sentenced to death at the age of 17, because you are considered as responsible of your own decisions. Would you be mature enough for a lethal injection but not for deciding who you chose as your girl friend ?
But even if you were still a "minor" in terms of s*x life at 17.5 (which you are not by US laws, and even less by French laws), one must admit that the "crime" of sleeping with a 17.5 year-old young man doesn't make you a pe*****le, and cannot compare with the crime of abusing a 13 year or a 7 year old.
In the USA - I checked - over half of the population under 18 has had consensual s*x. So, having consensual s*x at 17.5 is nothing harmful to the US society. Unless you regard half of US teenagers as depraved and debased.
Then, the issue behind your candid question, Ryan, is the fault committed by those who united their efforts to make sure that this healthy, attractive and educated young lady would get such a barbaric punishment: a quarter of a century of her best years in jail, and the wicked extra tragedy of never being a mother (jailed at 28 + 22 years time = 50 year old).
What makes this punishment appalling is the fact that Jennifer Fichter did not destroy anyone's house, vehicle or belongings, she did not sell drugs, she did not r**e, kill, abuse, kidnap, injure, insult, stalk, blackmail, or rob anyone.
This judgement is against all Christian values, Ryan, such as understanding, mercy and forgiveness.
Most of all, it is directly against the Bible, in the very words of the Lord Himself, forbidding us to decide or just accept and watch idly the stoning of the young female lover.
May God have mercy on those who watch her ordeal without compassion, especially those who could do something to stop it and free her, pardon her, but chose not to do anything so far.
