The biggest red flag in a personal injury case? Credibility.

There are a lot of things we look at when deciding whether a case is worth pursuing, but if what someone is telling us doesn’t line up with the medical records or the injuries are being exaggerated, that’s a problem.

And even when the other person is clearly at fault, a serious crash doesn’t always mean there’s a personal injury case if there wasn’t a significant injury.

Mario breaks down some of the red flags we look for when evaluating a potential case and why we don’t take every case that comes our way.

Using AI to Figure Out Your Personal Injury Case? Here’s the Problem.

AI can give you information. But it can only work with what you know to ask.

Maybe the driver who hit you only has $25,000 in coverage. Is that all there is? Maybe not.

There could be coverage through the vehicle owner, uninsured or underinsured motorist coverage, or other insurance you would never know to look for.

That’s where an experienced personal injury attorney makes the difference. We know the law, we know the players, and we know where to look for recovery.

Use AI to educate yourself. Don’t rely on it to make decisions about your case.

How injured do you need to be before calling a personal injury attorney?

There’s no perfect answer, but here’s a good rule of thumb: if the injury is affecting your life for more than just a few days, it’s worth having the conversation.

If you’re dealing with weeks of pain, missed work, limitations in your day-to-day life, broken bones, fractures, surgery, or ongoing treatment, that’s very different from being sore for a couple of days and getting back to normal.

Not every injury turns into a personal injury case. But if something is changing the way you live your life, you should at least know what your rights are and what your options look like.

That’s what we’re here for.

Most people have no idea they’re making these mistakes after a car accident—and unfortunately, insurance companies know it.

🚩 Three things an insurance adjuster hopes you do:

1️⃣ Give a recorded statement immediately.
You may think you’re simply telling your side of the story, but once it’s recorded, your words can be used later to minimize or dispute your claim.

Instead: Be polite, gather the adjuster’s contact information, and understand your rights before providing a recorded statement to the other driver’s insurance company.

2️⃣ Say, “I’m fine.”
After an accident, your adrenaline is working overtime. It’s common to feel okay at first, only to develop neck pain, headaches, or other injuries hours—or even days—later.

Instead: If you’re unsure how you’re feeling, it’s okay to say, “I’m still being evaluated and don’t know the full extent of my injuries yet.” Then pay attention to your symptoms over the next several days.

3️⃣ Wait to get medical care.
Delaying treatment can make it harder to connect your injuries to the crash, and more importantly, it can delay the care you need.

Instead: If you’re experiencing pain or discomfort, get evaluated by a qualified medical professional as soon as possible. Follow your provider’s recommendations and keep records of your appointments and treatment.

✅ After any accident, here’s what you should do:
• Check for injuries and call 911 if needed.
• Move to a safe location if it’s possible to do so.
• Call the police and request an accident report.
• Exchange insurance and contact information with the other driver.
• Take photos and videos of the vehicles, the scene, road conditions, and any visible injuries.
• Collect witness names and phone numbers if anyone saw what happened.
• Notify your insurance company promptly.
• If you’re injured or have questions about your legal rights, speak with an experienced personal injury attorney before making important decisions.

The insurance company has professionals protecting its interests. You deserve to understand your rights so you can make informed decisions from the very beginning. Wondering if you have a case? Give us a call for a free consultation 630-684-2332 and visit us online at PalermoLawGroup.com

Should you take the insurance company’s first offer? Usually, no.

A settlement is a negotiation, and unless that first offer represents everything available under the policy, accepting it right away may not be in your best interest.

But there’s another important piece: What are the policy limits?

Knowing how much coverage is actually available can make a major difference when evaluating an offer. And getting that information from the other driver’s insurance company isn’t always as simple as asking.

Before you agree to a settlement, make sure you understand both the value of your case and the coverage available.

At Palermo Law Group, we help injured clients navigate the insurance process and make informed decisions before accepting an offer.

Bigger isn’t always better.

These days, it’s easy to assume that the law firm with the biggest commercials, the most billboards, or the largest social media presence will provide the best representation.

But that’s not always how great results happen.

At Palermo Law Group, we’ve intentionally chosen a different path.

We don’t believe people should feel like they’re being passed through an assembly line. We believe they deserve to know the attorney handling their case, have their calls returned, understand what’s happening, and feel supported every step of the way.

When you hire Palermo Law Group, you’re not just another case number. You’re trusting us with one of the most difficult chapters of your life, and we take that responsibility personally.

That commitment shows up in the time we invest, the preparation we bring to every case, and the results we’ve achieved for our clients over the past three decades.

We’ve never measured success by how many cases we sign.

We measure it by how many lives we’ve helped rebuild.

Quality over quantity. Every time.

Because exceptional representation isn’t about being the biggest.

It’s about being the right firm when it matters most.

Settlement vs. Judgment: Here’s the difference.

Many people assume that once a lawsuit is filed, the next step is trial. In reality, that’s rarely the case.

A settlement can happen before a lawsuit is filed or at any point during the legal process. In fact, the overwhelming majority of personal injury cases are resolved through settlement before they ever reach a courtroom.

A judgment is different. It only happens when a case goes all the way to trial and a judge or jury decides the outcome.

At Palermo Law Group, every case is prepared as if it could go to trial, while always working toward the best possible resolution for our clients.
