DOS Pause on Visas for Commercial Truck Drivers

On August 21, 2025, the Department of State’s (DOS) Secretary Marco Rubio announced via a post on X that issuance of all worker visas for commercial truck drivers were being paused, effective immediately. No cable or other formal guidance has since been issued by DOS. The DOS announcement followed the U.S. Department of Transportation (DOT) statement that it was investigating a truck driver accused of negligence which killed three people in a Florida turnpike on August 12, 2025.

Guidance from Mission Mexico
Members report that applicants for H-2A and H-2B visas at U.S. Consulates in Mexico were being asked to provide additional information and documentation for certain occupations involving commercial motor vehicles. On January 8, 2026, the U.S. Consulate General Hermosillo, Mexico sent an email to stakeholders2, which indicates that H-2 applicants seeking to operate commercial motor vehicles in the United States must provide additional documents for screening at their consular interview.

USCIS Premium Processing Fee Increase – Who Pays More?

USCIS has announced a premium processing fee increase that will impact employers, HR teams, and foreign nationals filing employment-based immigration petitions.

Under the USCIS Stabilization Act, premium processing fees are adjusted every two years to account for inflation. If Form I-907 is filed on or after March 1, 2026, the new fees will apply.

In addition, the Trump administration moved to eliminate multiple exceptions included in the June ban. Specifically, the following three categories of people are no longer eligible for visas if they come from one of the 39 countries that are now subject to bans:
• Immediate relatives of U.S citizens.

USCIS IFR Removing Automatic Extension of Employment Authorization Documents

USCIS interim final rule ending the automatic 540-day extension of employment authorization documents (EADs) for all renewals filed on or after 10/30/25. The rule applies to all categories previously eligible for the extension. Comments are due 12/1/25. (90 FR 48799, 10/30/25)

This IFR amends DHS regulations to end the practice of automatically extending the validity of employment authorization documents (Forms I–766 or EADs) for aliens who have timely filed an application to renew their EAD in certain employment authorization categories. The purpose of this change is to prioritize the proper vetting and screening of aliens before granting a new period of employment authorization and/or a new EAD. This IFR does not impact the validity of EADs that were automatically extended prior to October 30, 2025 or which are otherwise automatically extended by law or Federal Register notice. DATES: This IFR is effective on October 30, 2025. Comments must be received on or before December 1, 2025. The electronic Federal Docket Management System will accept comments prior to midnight Eastern time at the end of that day.
