Ma*****na is legal in Massachusetts. But operating under the influence of ma*****na is still a crime, and it is completely different from alcohol OUI.
There is NO breathalyzer for THC. No number the prosecutor can point to. Police rely entirely on field sobriety assessments and drug recognition evaluations.
In Commonwealth v. Gerhardt, the SJC held field sobriety results are admissible for ma*****na OUI, but they show coordination, not impairment per se.
Drug Recognition Evaluators conduct 12-step evaluations that are highly subjective and are frequently successfully challenged by skilled defense attorneys.
An OUI ma*****na case requires an attorney who understands the specific science. Call me. This is not like any other OUI case.
