Life can be overwhelming when you're grieving the loss of a loved one, and timelines for legal matters are often the last thing on your mind. However, in Massachusetts, it's important to know about the "3-Year Hard Stop" for probate.

Generally, you have exactly three years from the date of a person’s passing to file for probate. If that deadline passes, the process becomes significantly more complex, and your legal options for managing the estate may become limited.

At Sawin Law, P.C., we understand that navigating these rules can feel heavy during an already difficult transition. Our team provides the steady guidance and discretion families on the South Shore need to move forward with confidence. We’re here to help you understand your timeline and ensure your loved one's estate is handled with the care it deserves.

If you have questions about probate or estate administration, don’t wait for the calendar to catch up with you. Let’s discuss how we can help.

Sometimes, the best way to move forward is by staying put for a while.

For many South Shore families navigating a divorce, a 'nesting' agreement can offer a sense of stability when life feels busy and uncertain. In a nesting arrangement, the children stay in the family home while the parents rotate in and out. It’s a solution designed to keep things steady: the school routines, the neighborhood friends, and the comfort of their own beds: while you figure out the next chapter.

While it sounds simple, a successful nesting agreement requires clear boundaries, thoughtful legal planning, and steady judgment. How are the household bills shared? Who handles the groceries? Having a detailed structure in place makes all the difference in making the transition manageable for everyone involved.

Whether you're in Hingham, Duxbury, or across the South Shore, we understand that protecting your family’s routine is your first priority. Let’s talk about how to create a plan that fits your family's unique needs.

When you're navigating a divorce, it's easy to focus on the house and the bank accounts. But what about the credit cards, the car loans, and the shared debt?

In Massachusetts, debt is divided "equitably": which doesn't always mean a clean 50/50 split. The court looks at things like who incurred the debt and each person’s ability to pay it back. Protecting your credit and your financial future is just as important as dividing your assets.

At Sawin Law, P.C., we help families across the South Shore and Plymouth County untangle these financial knots. Whether it’s negotiating who handles the joint balance or ensuring you aren’t left responsible for someone else's spending, we provide steady guidance to keep your future secure.

Divorce is a big transition, but your credit score doesn't have to be a casualty. If you’re worried about how debt will be handled in your case, let’s talk. We offer free consultations to help you find a clear path forward.

Reaching the final stages of estate administration brings a sense of relief, but choosing how to officially close the probate process is an important final decision. In Massachusetts, families typically choose between a Closing Statement and a Formal Complete Settlement.

A Closing Statement is often the more streamlined route. It can be filed by a Personal Representative at least six months after their appointment, provided all assets have been distributed and creditors paid. It’s an efficient way to conclude matters when the estate is straightforward.

A Formal Complete Settlement, on the other hand, involves a court decree. While it takes more time, it provides the Personal Representative with a higher level of legal protection and finality. This is often the preferred choice for complex estates or when there’s a need for a formal discharge of liability.

Navigating these technical details shouldn't be overwhelming. At Sawin Law, P.C., we provide the steady guidance needed to ensure every detail is handled with discretion and care, allowing you to focus on your family.

If you live on the South Shore, you’ve likely seen your home’s value climb significantly over the last few years. While that’s great for your net worth, it can create some unexpected hurdles for your family’s future.

In 2026, many local families are finding themselves navigating what’s often called the "Millionaire’s Cliff." With Massachusetts estate tax thresholds and rising property values in towns like Hingham, Duxbury, and Cohasset, a family home can quickly push an estate into a taxable bracket.

It’s not just about the numbers; it’s about the legacy you’ve built. Thoughtful planning today helps ensure that your home remains a source of security for your loved ones rather than a source of stress. Whether you are looking to update an existing plan or are just starting to think about estate administration, we are here to provide clear guidance and steady judgment.

We understand these transitions can feel complex, but they don't have to be overwhelming. Let’s make sure your plan reflects the life you’ve worked hard to build right here in Plymouth County.

In 2026, we’re seeing a significant trend among South Shore couples: the Joint Revocable Trust. While estate planning is always personal, this specific approach is gaining popularity for its ability to simplify life during difficult transitions.

One of the primary reasons married couples are choosing this path is the tax benefit. A properly structured Joint Revocable Trust can provide a "full step-up in basis" on assets when the first spouse passes away. This means that if you own a home in Hingham or Duxbury that has appreciated over the years, your heirs could avoid significant capital gains taxes later on.

Beyond the numbers, it’s about peace of mind. Managing one trust together is often more intuitive than maintaining two separate ones. It allows for a unified vision for your family’s future, ensuring that your intentions are clear and your loved ones are protected.

At Sawin Law, P.C., we take a thorough, analytical approach to your estate. We understand that these decisions are about more than just documents( they’re about your legacy.)
