Breaking news and effective 8/1/22: Illinois domestic workers must receive overtime, minimum wage and meal breaks. This applies to private individuals and families as well as agency employers. If you have a nanny, babysitter, caregiver, housekeeper or other domestic worker in Illinois, learn your obligations under the new amendments, including record keeping, providing true rest periods and more.

Don’t let your AI unlawfully screen out candidates with disabilities!

Last week, the Equal Employment Opportunity Commission and the Department of Justice Civil Rights Division sounded a warning for employers and issued guidance on avoiding AI disability discrimination.

The EEOC new technical assistance document and the DOJ’s guidance provide information on proper use of AI-powered tools. AI should not exclude candidates with disabilities who are qualified to perform the job with reasonable accommodations. Employers are required to provide such accommodations starting with the hiring process. Start by asking your AI vendors about their approach to accessibility, including avoiding prohibited questions.

According to the U.S. Bureau of Labor Statistics, individuals with disabilities face unemployment rates almost twice as high as other workers. Employers, let’s create – not negate - opportunities!

Employers now have a wide variety of computer-based tools available to assist them in hiring workers, monitoring worker performance, determining pay or promotions, and establishing the terms and conditions of employment.
