A lot of fear has been circulating about the recent USCIS policy memo on Adjustment of Status. Let’s clear a few things up:
Adjustment of Status has NOT been eliminated.
People are NOT suddenly being denied across the board.
And no! this memo does not mean everyone now has to leave the U.S. to process abroad.
What the memo actually does is reiterate something immigration law has always said: Adjustment of Status is a discretionary form of relief. USCIS officers already had discretion. A policy memo cannot override federal immigration statutes or existing regulations.

What will likely happen in practice?
• More RFEs
• More Notices of Intent to Deny
• More scrutiny of evidence, credibility, and discretionary factors
