The Federal Trade Commission has jurisdiction over Made in the USA claims, and enforcement has become a top priority. In March of 2026, President Trump signed an Executive Order titled “Ensuring Truthful Advertising of Products Claiming to be Made in America,” putting a renewed focus on the issue.

The eFiling rule will impose new requirements for how importers manage product certificate data, not which products require a certificate. Any consumer product that is subject to a CPSC rule, ban, standard, or regulation will continue to require a Certificate of Compliance, which will be eFiled at the time of entry.

The Court of Appeals for the Federal Circuit stayed the ruling, so the tariffs remain in effect while the litigation plays out. If the CIT's order does prevail, the Court has made clear that relief is limited to named plaintiffs.

That means importers seeking refunds should take affirmative legal action rather than wait for automatic relief or file protests with CBP.
