One of the things many people don't realize about guardianships is that not everyone is legally eligible to serve as a guardian.
In this part of my Guardianship Series, I discuss an important rule that often catches families by surprise: if you have been convicted of a felony, you generally cannot be appointed as a guardian, even for your own child. While there are many situations where rights may be restored over time, guardianship laws remain very strict because guardians are entrusted with the care, well-being, and assets of another person.
This can create significant challenges for families, especially when there are limited options for who can serve. Understanding these requirements before a crisis occurs can save time, money, and stress.
