📜 Stamped by Shug – Arkansas Notary Policy
1. Purpose
This policy ensures that all notarization services provided by Stamped by Shug Notary Services fully comply with Arkansas state law while upholding the highest standards of integrity, accuracy, and professionalism.
2. Identification Requirements
A valid, government-issued photo ID is required for all notarizations.
Acceptable IDs include a driver’s license, state-issued ID card, U.S. passport, U.S. military ID, or other government-issued identification that is current and contains both a photo and signature.
If satisfactory identification cannot be provided, notarization will be refused.
3. Document Requirements
Only legal and properly completed documents will be notarized.
Documents containing blank spaces, missing signatures, or incomplete information will not be notarized.
The signer must be physically present for all in-person notarizations (unless Arkansas remote notarization requirements are legally satisfied).
4. Signer Requirements
The signer must appear willing, competent, and able to sign.
Service will be refused if there is any suspicion of coercion, duress, or mental incapacity.
The signer must sign the document in the presence of the notary, unless the act is an acknowledgment where a prior signature can be acknowledged.
5. Prohibited Acts
In accordance with Arkansas Code § 21-14-111, the following acts are prohibited:
Notarizing a document without the signer’s presence (unless performing a legally authorized remote notarization).
Notarizing a document in which the notary has a direct financial or beneficial interest.
Notarizing a document the notary knows or believes to be false or fraudulent.
Providing legal advice, drafting, or preparing legal documents unless the notary is a licensed attorney.
6. Record Keeping
A notary journal is maintained for each notarization (when required by Arkansas law).
Entries include the date, type of notarial act, name of signer, type of ID presented, and a brief description of the document.
7. Fees
Notarial fees are charged in accordance with Arkansas Code § 21-6-309 (state-regulated maximums).
Travel or convenience fees, if applicable, will be disclosed and agreed upon before the appointment.
8. Refusal of Service
Notarization will be refused if:
The signer fails to present acceptable identification.
The document is incomplete, illegal, or suspected fraudulent.
The signer appears unwilling, coerced, or incompetent.
Proceeding with notarization would violate Arkansas law.
9. Legal Compliance
Knowingly presenting false, forged, or fraudulent documents for notarization is illegal and may result in criminal charges, fines, or imprisonment under Arkansas law.
Stamped by Shug Notary Services reserves the right to report suspected fraud or illegal activity to the proper authorities.
