Went to trial on a DWI. Client blew a .26, which is over 3 times the legal limit. Got all evidence suppressed and client was found not guilty!!! 50-6!!!

Started a federal jury trial on Monday. The case ended today after the judge declared a mistrial after I, to be polite to the other side and the officers involved, called the government and its witnesses out for providing information in discovery that was misleading in the least and to some observers much worse than that. After battling the government fir most of the day yesterday the judge declared a mistrial, at which time moved the court fir sanctions and attorney fees. I also requested that my client be released from custody. At the hearing on client’s release the government moved to dismiss the indictment. I agreed to dismiss my motion for attorney fees and sanctions. Client walked out of custody today a free man!!!

Had a DWI trial today and hit a not guilty verdict on the DWI. Lost the refusal to submit to arrest and failure to present driver’s license. It was a fun trial because the prosecutor, the trooper and the judge were all consummate professionals. Days like today remind me how much I enjoy practicing law.

This week just got even better. I started a jury trial yesterday. The client was charged with 5 counts of delivery of a controlled substance, 4 counts of possession of paraphernalia, and one count of maintaining a drug premises. The original plea offer totaled 60 years. The State later reduced their offer to 30 years. Client wouldn’t take either. We started the trial. I caught the State on an issue. The issue would have resulted in a mistrial which would have resulted in us having another jury trial. The State agreed to let my client plead to 20 years. Saves my client 40 years off the initial offfer!

The second piece of good news was that a judge granted a motion to suppress evidence I filed. We had the hearing back on November 20, 2025. The judge took the issue under advisement and ruled today granting my motion to suppress!!!

Really good week. It’s weeks like this that carry us through the rough ones.

Well so far another good week at The Cannon Law Firm. Was again named one of the best criminal/DWI lawyers and won another DWI!!! That makes it 45-6!!!!

Well very busy day! Had two DWI trials today. The first involved a motorcycle wreck. A blood draw showed a blood alcohol concentration .224,almost 3 times the .08 limit. The other stop was based on a mad ex calling the cops claiming my client was driving drunk. Client stopped for speeding. A blood draw showed a blood alcohol concentration of .10. Both blood draws were suppressed and both clients found not guilty. The one client was found guilty of Speeding. Can’t win them all. 44-6,

Had an underage Boating While Intoxicated trial a couple of months back. Lost after trial. The loss did not sit well with me or my client. My client chose to appeal. At arraignment in circuit court I asked the prosecutor to look at the video of the stop. Well today the underage boating while intoxicated charge was dismissed. 42-6!

Well today is the 28th anniversary of my becoming a lawyer. I celebrated it in truly lawyerly way by having a jury trial. While I waited while the jury deliberated its verdict I had time to reflect on my 28 years I thought back to the fresh faced baby lawyer who took his oath. I wondered where the time had gone. When had I gone from being a baby lawyer to a part of the old guard. Young lawyers now come to me for advice. The change was so gradual I did not notice it until it was too late.

I want to thank all those who helped me make it this far. Herb Wright who gave me a chance, Harold Craig and John T. Harmon who mentored me, and Mark Jesse who talked me into starting my own firm and helping me get it off the ground. Most importantly my family who sacrificed so much for my career.

I hope I have helped some of my clients over the years and pray I am allowed to continue to do so for years to come. Thank you all for your support over the years.

P. s. Client was charged with commercial burglary and misdemeanor assault. He was offered probation but chose to go trial. He was found guilty of both offenses but the jury decided that a fine was sufficient. It’s a win because we beat the plea, but a hollow victory because I really didn’t think my client deserved a criminal record.

Another not guilty on DWI!!! Client was found guilty of refusal to submit to chemical test though. 41-7!!!!

06/17/2025

Two cases today. One wet for pre-trial and one set bench trial. The case set for bench trial was a theft by receiving. Client honestly bought the car through his car lot. Spent good money fixing body damage. Gets stopped taking the car to be detailed. The case was passed to be dismissed. Second case was set for jury trial Wednesday. Client charged with possession with purpose to deliver, possession or paraphernalia and possession of ma*****na. Case passed to be dismissed. 2 clients go home happy today.
