Every year, many injured workers never file a workers’ compensation claim because they’re afraid of what might happen next.

In New Jersey, the law protects workers far more than people think, and many common fears are based on myths. So we made this FAQ for you.

You generally cannot be fired for filing a workers’ comp claim. If your employer punishes, pressures, or tries to push you out because you asserted your rights, that may be illegal retaliation. Settling a case also does not automatically mean you must quit your job. Employment depends on medical restrictions and available work, not the act of filing.

Workers’ compensation is a no-fault system. You may still qualify even if you made a mistake, were distracted, or partly caused the accident. Aggravations of old injuries and worsening pre-existing conditions can still be covered if work contributed to the problem.

Immigration status usually does not affect eligibility. Undocumented workers, cash-paid employees, and visa holders can still receive medical treatment and benefits. Filing a claim does not trigger immigration enforcement.

Drug tests and social media posts do not automatically defeat a case. A positive test must relate to impairment causing the accident, and normal daily activities do not equal fraud.

Even injuries during travel for work, events, or working from home may qualify depending on circumstances. If you’re unsure, ask before deciding not to file.
