New Jersey Attorney General Gurbir Grewal has instructed "all municipal prosecutors in New Jersey seek an adjournment until September 4, 2018, or later, of any matter involving a ma*****na-related offense pending in municipal court." This move comes on the heals of the AG's admonishment of Jersey City's chief Municpal Prosecutor for having instructed his subordinates to effectively decriminalize ma*****na by permitting downgrades or outright dismissal ma*****na related charges. Municipal prosecutors are permitted "in the interest of justice" to take such actions but almost all decline to recognize such authority.
The AG's action today taken together with the passage of a ma*****na legalization bill that is scheduled to be considered in September could effectively end prohibition in NJ.
Currently a conviction for possession even residue amounts of ma*****na call for six months of drivers license suspension, as much as $1.300 in fines and assessments, up to six months in jail in addition to other penalties including DNA collection. Such convictions also carry collateral consequences. For example, a college student with a ma*****na-related conviction would be barred from receiving federally subsidized school loans.
Ma*****na possession's been decriminalized in New Jersey's municipalities -- at least until September, when an adult use legalization bill is expected to hit the state Senate, sources said.
