What to Expect & Key Considerations
Chapters: Chapter 7 wipes out unsecured debt (credit cards, medical bills) by liquidating non-exempt assets. Chapter 13 creates a 3-5 year repayment plan for those who don't pass the Chapter 7 means test or those who are behind on secured debt (i.e. home, car, etc.)
Exemptions: Mississippi law protects certain property, like your home (homestead) and vehicle, up to certain values, meaning they can't be sold in Chapter 7.
Non-Dischargeable Debts: Student loans, recent taxes, child support, and alimony are generally not erased by bankruptcy.
