The California Foreclosure Timeline

Day 1 of a Missed Payment:
A payment isn't made by the due date (often with a short grace period). The loan becomes “delinquent.” Late fees may apply. After 30 days with no payment, credit agencies are notified and your credit report will reflect a 30 day late.

What to Do:
Contact your servicer immediately. This is the easiest point to arrange a repayment plan or forbearance.

In California, most foreclosures are “nonjudicial,” meaning they happen outside of court through a power-of-sale process spelled out in the Deed of Trust you signed when you closed on the purchase of your home. That process is run by a neutral third party called a trustee, not by the lender directly.

If you've received a late notice, a Notice of Default, or even a Notice of Trustee's Sale, it does not mean losing your home is inevitable. Foreclosure is the legal process a lender uses to recover the balance owed on a home loan when a borrower has stopped making payments, by forcing the sale of the property. Welcome to a series on understanding foreclosure.

This process occurs in stages over months, and California law builds in specific notification periods and homeowner rights along the way. So the quicker you seek assistance the better your chances are to save your home or at least any equity you may have.

The first step in Foreclosure is “Pre-foreclosure”. This term is not an official legal term, however it's commonly used to describe the entire window between your first missed payment and the actual trustee's sale. The notice you will receive is called a Notice of Default (NOD). This is the most important window for a homeowner, because nearly every option — reinstating the loan, modifying it, selling the home, or arranging another path forward — is still on the table.

What does this mean for you? It means, you have options and a little time to decide what solution works best for you and your family.
