According to recent statements by the California Department of Corrections & Rehabilitation, the current statewide COVID-19 count (as of July 6, 2020) of incarcerated persons is 2,419 with currently over 500 active cases in CDCR employees.

Understanding how to get an expedited release from state prison is no easy task. Since the June 16th announcement by the CDCR of a Community Supervision Program, there has been little information specifying exactly how eligible inmates are to apply for release.

Eligibility Criteria for Expedited Prison Release
Inmates who meet the following criteria may be eligible:

· Non-violent Crimes - Must not be serving sentence for crimes of domestic violence or other violent crimes defined by law

· Risk Assessment - Must not have California Static Risk Assessment score indicating a high risk for violence
· Housing Plans - Must have housing plans identified before release
· 180 or less Remaining Sentence - Inmate's remaining sentence must be less than 180 days
· COVID-19 Testing - Must submit to COVID-19 testing

Inmate Release Process & COVID Testing

Beyond meeting eligibility criteria, inmates must have a parole officer conduct a pre-release verification. The parole officer will then determine if he or she deems their housing plan as suitable, in which case the inmate's release is granted or denied.

The CDCR has indicated that the "screening and releases will continue on a rolling basis until CDCR determines they are no longer necessary".

Inmates being released from any CDCR institution will receive COVID-19 testing one week prior to release and screened for any symptoms.

We are pleased to announce our recent success in an important Habeas Corpus case resulted in a Court of Appeals published opinion recognizing the broad powers of the trial courts to resolve issues related to habeas corpus proceedings, including re-sentencing.
We filed a petition for writ of Habeas Corpus on our client’s behalf in the Court of Appeals which was also denied. Finally, after filing a petition for review, the California Supreme Court granted review and ordered the case returned to the lower court for an order to show cause why the writ of habeas corpus should not be granted. Prior to the hearing in the trial court, the district attorney’s office failed to file a return or objection to the habeas petition. During the hearing, the court noted this failure, granted the relief in the petition and re-sentenced our client to credit time served which was a little over 4 years by this time.

Convicted of murder, Ordered release from prison.

Our client was convicted of murder, who was unarmed in the ninth car in a drive by shooting when he was 17 was tried as an adult and facing 40-year to life. This week he has gotten his life back and was ordered released from custody after attorney Correen Ferrentino successfully argued at his previous hearing that his case should remain in juvenile court and he should be sentenced to 2 years in a juvenile facility. The client preformed exceptionally well in custody and earned a certificate as a firefighter. He hopes to go on to become an architect. We not only celebrate our client’s release but his willingness to avail himself of this second chance.

This week we secured a dismissal in a DUID case (driving under the influence of drugs) in the Harbor Justice Center.

Our client suffered a prior traumatic brain injury and was taking prescribed medication.
