A Guardian ad Litem (“GAL”) is a professional appointed by the court to investigate, report (and often make recommendations) as to child custody and parenting time. A GAL can be a lawyer (Category F) or a mental health professional (Category E). If custody is contested and it is hard for the court to determine what is in the children’s best interests, it is likely the judge will appoint a GAL in your case. If you are in the middle of a dispute and are concerned your child’s needs are not being addressed, you can request one. The average litigated divorce takes more than two years to get to trial and after that five months (or more) go by before you get a judgment. Alternative Dispute Resolution goes a lot faster. A custody judgment can be changed if the Court finds that there has been a “material and substantial change” since the original judgment entered and a modification “is necessary in the best interests of the children.” Whether the circumstances warrant a change in any given case is up to the Judge. Consider how long it has been since the original order was entered. The more time that has passed, the more likely a Judge will consider making a change. What else is different? Has one or both of the parents moved? Is there a reason the child would be better off if the custody arrangements were different. This is a judgment call and in some cases the court will simply refuse to make a new order on the grounds that the change alleged is not “material and substantial.” We handle these kinds of requests every day.
