The New Jersey Supreme Court reversed the Appellate Division this week, holding that a 2019 amendment expanding passive abuser liability applies prospectively only—not retroactively.

The amendment eliminated the “within the household” requirement for passive liability, significantly broadening the scope of potential defendants, including schools and other institutions. Because claims under the statute allow prevailing plaintiffs to recover attorneys’ fees and costs, retroactive application would have substantially increased exposure for organizations facing historical claims.

Walsh attorneys Peter J. Pizzi, Eric S. Padilla and Carmen I. Abrazado advocated for reversal through an amicus curiae brief on behalf of the New Jersey Defense Association, arguing that the amendment created a substantive expansion of liability and should not impose new legal exposure for conduct that occurred before the amendment’s December 1, 2019 effective date.
