Recent NY legislation has made it nearly impossible to evict or eject defaulting commercial tenants.

However that didn't stop our client from obtaining summary judgment for an order permitting eviction as soon as the legislation expires without the need to go back to court.

Our client was resigned to continue receiving late rent because their commercial lease did not have a chronic late payment clause. Thankfully we were able to use the conditional limitation in the lease to obtain possession via holdover.

Judge Unger's 4-page decision also clarifies when acceptance of rent post-termination constitutes a waiver and whether including attorney's fees in commercial housing court is appropriate under the 2019 Tenant Protection Act.

The 2019 NY Tenant Protection Act makes it more difficult to manage landlord-tenant litigation. However, a careful reading and application of the new rules enabled us to defeat an order to show cause intended to delay possession.

Because our client strictly complied with their purchase and sale agreement they avoided lengthy litigation and obtained summary judgment.

Our client's commercial tenant defaulted and abandoned the property. A well-drafted rent acceleration clause enabled us to obtain a default judgment for $219,000.00. If you're a NY landlord make sure your rent acceleration clause is enforceable.

Good news for buyers and investors looking to purchase in NYC.

It's not just luxury-home listings that are piling up in New York City. Even units for less than $1 million — within reach of far more people than a Billionaires' Row penthouse — are hurting for buyers. In Manhattan, the inventory of sub-...

After months of intense litigation involving cutting-edge rent stabilization concepts, and on the eve of trial, my client compelled their landlord to concede that their apartment was rent stabilized.

If you're a NYC landlord considering IAIs to convert an apartment to market rent or thinking of buying a building which contains recently converted apartments, plan carefully.
