Someone is selling your product under your name. What now?

That is the call. It usually comes in a panic, usually with a screenshot attached, usually from a founder who found their own listing on Amazon with worse photos and a lower price.

The answer is either yes or no, and it gets decided long before the copycat shows up.

Yes sounds like this. You own the trademark, we send the notice, the marketplace pulls the listing, you go back to running your business.

No sounds like this. You have an LLC and a domain and three years of building the name, but no registration, so the first thing we have to do is prove you have any right to the name at all. That is the expensive version.

The clients who get the fast yes are not the ones with the best lawyers. They are the ones who filed before they needed to.

Do the boring thing early so the emergency stays boring.

Before you spend a dollar on your brand…

Make sure the name is actually available.

Someone else may already be using the same or a confusingly similar name.

A trademark clearance search can help identify those issues before they become expensive ones.

It’s much easier to change a name before you launch than after you’ve built a brand around it.

You only launch once.

Mahomes and Kelce’s steakhouse 1587 Prime is being sued by sneaker company 1587.

A sneaker company and a steakhouse should have nothing to fight about. Then the steakhouse started selling merch.

The sneaker company says it used the name first, but waited more than two years to file a trademark application. Now, the two brands are fighting over the name in federal court.

The takeaway for business owners is simple: search before you commit to a name, and file your trademark application early. A proper search can uncover potential conflicts before you invest in a brand. Filing early puts you in a stronger position if a dispute arises later.

Protect the name before you build the business around it.

Your LLC, domain name, and Instagram handle all serve different purposes.

A trademark is what protects your brand.

It can protect your business name, logo, slogan, and other branding insignia that tells the public who they’re buying from.

The purpose of trademark law is to protect the consuming public by preventing confusion about the source of the goods.

That’s why owning an LLC, buying a domain, or claiming an Instagram handle doesn’t really protect you.

If your brand is one of your most valuable business assets, make sure you are protecting it from the start. Otherwise, you could be getting a serious call from your attorney like in the video above.

AI is a powerful tool. Legal advice is not something you should take at face value.

AI can point you in the right direction, but it doesn’t have a law degree, has never been to court, and is unfamiliar with the nuances of the law.

An Amazon suspension can shut down an entire business overnight.

Our client’s page, that was selling five to six thousand books a day, was taken down after a counterfeit complaint filed by a major book publishing company in the US.

We stepped in, addressed the complaint with opposing counsel, and pushed the matter forward strategically.

Ten days later, the page was back up.

Amazon disputes are fact sensitive, and the right response can make all the difference.

If your Amazon account has been suspended or your listings were removed after an IP complaint, Yomtobian Law can help.

You’ve heard the terms trademark, copyright, and patent. But do you know what each one actually protects?

A trademark can protect a brand name, logo, slogan, product packaging, color, sound, and even a distinctive scent.

Copyright protects original creative works, including photographs, videos, music, artwork, books, website content, and software code.

A patent can protect a new invention, product design, machine, process, chemical composition, or technological improvement.

Knowing the difference is the first step toward protecting the right part of your business.

My client just emailed me this: “I thought we already paid all the trademark fees.”

We had. The $1,320 “publication fee” was a scam.

The notice used his real application information, looked official, and gave him 10 days to pay. But it was not from the USPTO. Buried in the fine print, it admitted that it was only an offer to list the trademark in a private database.

Trademark filings are public, which makes it easy for companies like this to target applicants with convincing letters and emails.

Our clients know that legitimate USPTO correspondence comes through our office. They should never respond to an unfamiliar notice or pay an unexpected fee before sending it to us first.
This is exactly why having a trademark attorney matters.

You should not have to guess whether a notice is real.

One of the best calls we get to make.

The USPTO gave a notice of allowance to one of our clients trademarks, giving the brand stronger federal protection and a registration to support future enforcement.

A strong brand is worth protecting from the start.

Yomtobian Law helps businesses register, protect, and enforce their trademarks.
