On April 19, 2021, Chief Judge Janet DiFiore announced that Judges and Court Staff will return to court on May 24th, 2021. The goal of the move is to "support the fuller resumption of in-person operations, including jury trials and other proceedings in our courts."

COVID safety measures that have already been implemented, including, COVID screening, temperature checks, face mask use, and social distancing protocols will all continue.

For all debating the recent social media prohibitions of Donald Trump I give you this short summary of one of the original and most famous Supreme Court cases regarding free speech to consider

Schenck v. United States (1919)
Justice Oliver Wendell Holmes stated in this case his famous aphorism about “falsely shouting fire in a theatre” and set forth a “clear and present danger test” to judge whether speech is protected By the First Amendment -

The question he wrote “ is whether the words are used in such circumstances and are of such a nature as to create a clear and present danger that they will bring about the substantive evils that Congress had the right to prevent. It is a question of proximity and degree”

In the case the Court affirmed the convictions of the defendants for conspiring to violate certain federal statutes by attempting to incite subordination in the armed forces and interfere with recruitment and enlistment. During wartime the defendants mailed to new recruits and enlisted men leaflets that compared military conscription to involuntary servitude and urged them to assert constitutional rights.

No matter what side you are on - the Supreme Courts ruling in the case brought by Texas to challenge the election results shows the independence and non-partisanship of the Court - and adherence to the rule of law. Vital from this branch of our government in these troubled times. Lets hope they continue to do so.

Today our country suffered a tremendous loss in the passing of Supreme Court Justice Ruth Bader Ginsburg. A brilliant legal mind coupled with an intense belief in the rights of all people and a true champion of women’s rights. She wrote many important Supreme Court decisions as well as blistering dissents on a myriad of legal issues presented to the Court. Our country and democracy was privileged to have the likes of such a Justice on the Court.

Very happy to report. young 9 year girl a victim of a dog bite in Brooklyn received a settlement award of $300,000.00 where we were able to put her money in an annuity which will grow and assure her of more than needed funds for college and years to come after that.

First COVID trial

New York City is entering its second phase of opening shortly. With this opening the New York City Courts will be implementing procedures to proceed with cases. This is welcome news for so many of our clients who have had their cases on hold due to the pandemic.
