Randy's law school education earned him two degrees: one in common law, and one in civil law. Many people are unaware that although common law is practiced in the US, the UK, and everywhere in Canada except for the province of Quebec, most countries have civil law systems. Randy has substantial knowledge and experience in both civil and common law, which in his opinion is crucial to the successful practice of international business law. Before turning to international business law and its many facets, Randy practiced commercial litigation, personal injury law, employment law, real estate law, and insurance coverage law. When Randy practiced personal injury law, he was the top producer in his firm because he always battled hard for his clients. However, he learned from his years as a litigator that he would rather help business clients avoid litigation than fight when things have gone wrong. After working at several larger law firms, Randy aimed to provide more personalized and effective representation at his own boutique law firm. We use the word โ€œpersonalizedโ€ to describe Randy's representation of his clients because he is very accessible and is involved in all his matters from start to finish. We post on LinkedIn regarding various topics touching on legal issues pertaining to startups, small and midsize businesses, and investors, often with an international aspect. Maritime law is all over the news these days!

The US announced today that it seized two tanker ships as part of its efforts to block sanctioned oil exports from Venezuela, including one that was recently registered under the Russian flag.

The US European Command stated that the tanker, formerly known as Bella 1, was seized in the North Atlantic for violating U.S. sanctions on Venezuelan oil.

The ship, now known as Marinera, is one of many Russia has reflagged to join its โ€œdark fleetโ€.

Under the principles of maritime law, a vessel is essentially considered a floating extension of the country whose flag it bears.

This has led to the growing phenomenon of โ€œdark fleets," a subset of the wider term โ€œshadow fleets," which also includes โ€œgray fleets.โ€ Vessels within shadow fleets are believed to engage in clandestine maritime activities, posing significant challenges to international regulations and trade policies.

Shadow fleets have rapidly expanded, now representing roughly 10% of global seaborne oil transport. Indicators of shadow fleet activity include disabled Automatic Identification System (AIS) transmitters, inconsistent vessel data, unusual behavior, opaque ownership, and aging ships. These fleets cause economic disruptions, help evade international sanctions, and create environmental and safety hazards.

Addressing shadow fleets poses regulatory challenges, particularly given their use of flags of convenience and complex ownership structures. Their presence is a crucial concern in maritime security and policy, as they offer insights for policymakers, industry players, and researchers to develop strategies to manage the risks they pose to global maritime trade.

Think international trade is just domestic trade with a passport? Not even close.
