On January 20, 2025, President Donald Trump signed an executive order titled “Protecting the Meaning and Value of American Citizenship,” aiming to restrict birthright citizenship. The order seeks to deny automatic U.S. citizenship to children born on American soil if their parents are not U.S. citizens or lawful permanent residents. This includes children of parents unlawfully present or on temporary visas.
The order challenges the 14th Amendment’s Citizenship Clause, long understood to grant citizenship to nearly all individuals born in the U.S., regardless of their parents’ status. Legal experts argue the order contradicts constitutional law.
Civil rights organizations such as American Civil Liberties Union (ACLU) and state attorneys general have filed lawsuits, claiming the order is unconstitutional.
On January 23, a federal judge (U.S. District Judge John Coughenour) temporarily blocked the measure, calling it “blatantly unconstitutional.” The Department of Justice plans to defend the order, paving the way for significant legal battles that will shape the future of birthright citizenship in the U.S.
