$97,216,704 VERDICT!
Managing Partner Charles E. Wisell, Esq., who led the litigation and trial, with the assistance of Michael A. Marando, Esq., secured a record-setting $97,216,704 verdict for a young woman who, at just 15 years old, suffered catastrophic injuries as a result of a dangerous roadway condition.
The case involved one of the most dangerous intersections in Nassau County. Despite 108 motor vehicle accidents resulting in injuries and fatalities, and repeated warnings from the Nassau County Police Department and local legislators, the County of Nassau refused to take meaningful steps to address the known dangers at the intersection. Our client, along with the three other children who were with her that day, suffered the consequences of the County's failure to keep its roadway safe.
Although she survived, our client endured months of hospitalization, multiple brain surgeries and years of rehabilitation for her permanent, life-altering injuries. For years, our team worked closely with the family. We spent countless hours preparing for trial, meeting with our client and her family in their home, learning about their lives before and after the incident, and gaining a firsthand understanding of the challenges they face every day. Those experiences reinforced what was at stake and why this case mattered.
We firmly believe that when a municipality has notice of a dangerous roadway condition, fails to take reasonable action to address it, and people are harmed as a result, accountability must follow.
This verdict represents an important step toward justice for our client and her family after an extraordinarily long journey. We are grateful to the jury for their careful attention throughout this lengthy trial and honored to have been entrusted with the responsibility of representing our client and her family.
