One Partner Steps Back From Work. Should Your Agreement Step Up?

Sometimes, building a life together means one partner takes a step back from their career so the family can move forward.

Maybe it's to raise children, manage the household, support a partner's growing business, or simply make life work during a busy season.

These are decisions couples often make together, but they can have very different financial effects on each person's future.

Stepping away from work, even temporarily, can affect retirement savings, career growth, earning potential, and long-term financial independence.

That's where a thoughtfully structured prenuptial or postnuptial agreement can make a difference.

Couples can explore provisions that recognize caregiving contributions, address career interruptions, and create clearer financial expectations as their lives evolve.

Because building a life together means recognizing the different ways both partners contribute—not just what's reflected in a paycheck.

A good agreement isn't about one person protecting themselves from the other. It's about creating balance, understanding shared responsibilities, and planning for a future that works for both.

💡 Friday Tip: Look Beyond the Paycheck When Calculating Support

A paycheck doesn't always tell the whole financial story!

If you're navigating child support or spousal maintenance, take the time to gather more than just pay stubs. Bonuses, commissions, business income, tax returns, and other financial records can all help paint a clearer picture of someone's earnings.

And remember, what someone earns today may not always reflect their full earning capacity. Depending on the circumstances, courts may consider what a person could reasonably be earning, too.

The takeaway? Don't make support decisions based on assumptions. Make them based on the full financial picture.

A little financial clarity now can help prevent bigger questions later.

How much child support should you expect to pay—or receive—in New York? ⚖️

New York uses a formula to calculate child support, but the final amount can depend on much more than a parent's paycheck. Income, the number of children, parenting arrangements, and additional expenses can all influence the outcome.

Here are 3 key takeaways from the blog:

• Child support starts with a formula. New York applies statutory percentages based on the number of children, using both parents' adjusted incomes. For 2026, the combined parental income cap is $193,000.

• Income isn't always just a salary. Bonuses, commissions, business earnings, investments, and other financial resources may factor into the calculation.

• The basic payment may not cover everything. Childcare, health insurance, unreimbursed medical expenses, and certain educational costs may be added. Even a 50/50 parenting schedule doesn't automatically eliminate child support.

Understanding how child support is calculated can help both parents plan more confidently, establish clearer financial expectations, and keep their children's needs at the center of the conversation.

The evidence gathered in the early stages of a case can have a significant impact on what happens next.

Your Paycheck Isn’t Always the Whole Income Picture

When it comes to calculating child support or spousal maintenance, you might think the starting point is simple: look at what someone earns, do the math, and move on.

But income isn't always as straightforward as what's printed on a paycheck.

Business earnings, bonuses, commissions, past earning history, and other financial resources can all play a role in determining support. And in certain circumstances, courts may even consider what someone could reasonably be earning, rather than just what they're currently bringing home.

This is known as income imputation, and it's one of the reasons support calculations aren't always as simple as they first appear.

Whether you're self-employed, changing careers, running a business, or navigating a new financial chapter, understanding the full financial picture matters.

Because fair financial decisions start with accurate information—not assumptions.

💡 Friday Tip: Don’t Wait for the School Bill to Have the Conversation 🎒

School expenses can add up quickly — and not every cost is as predictable as tuition or after-school care.

When creating or reviewing a parenting agreement, consider how you’ll handle sports, tutoring, activities, school trips, equipment, and other unexpected expenses. Will costs be shared? Does one parent need to approve an expense before the other commits? How will reimbursements work?

Getting specific now can mean fewer “Who’s paying for this?” conversations later.

Clear expectations around expenses help keep the focus where it belongs: on your child.

Here are 3 key takeaways from the blog:

• The recipient’s remarriage usually ends future maintenance. However, the divorce judgment or settlement agreement matters and may include specific notice, proof, or court-filing requirements.

• The paying spouse’s remarriage usually does not end the obligation. A new marriage or new household expenses do not automatically cancel or reduce an existing maintenance order.

• Cohabitation and remarriage aren’t necessarily treated the same way. Living with a new partner does not automatically end maintenance, and the specific terms of the divorce agreement can make a significant difference.

Before changing or stopping payments, review the actual agreement or court order. When it comes to remarriage and maintenance, the exact wording—and the proper legal process—matter.
