⚠️ Важно: на данный момент это не новый закон и не окончательная отмена adjustment of status внутри США. USCIS опубликовал заявление о политическом направлении и более жестком подходе к тем, кто приезжает по временным визам, а затем подает на грин-карту внутри страны. Но сама процедура adjustment of status по многим категориям пока продолжает существовать.

USCIS опубликовал заявление, которое может сигнализировать о серьезных изменениях в иммиграционной политике США.

Согласно заявлению, люди, находящиеся в США временно : туристы, студенты, обладатели рабочих виз и других неиммиграционных статусов, в большинстве случаев должны будут возвращаться в свою страну для оформления иммиграционного процесса и получения грин-карты через консульство, а не внутри США. Исключения обещают делать только при “экстраординарных обстоятельствах”.

На сегодняшний день adjustment of status внутри США все еще остается законной опцией для многих категорий заявителей. Однако подобные заявления USCIS, очень серьезный сигнал ужесточения политики и усиленного контроля за теми, кто въезжает по временным визам с последующим намерением остаться в США.

A federal judge has issued a stay barring ICE from apprehending immigrants attending legally mandated immigration hearings. U.S. District Judge Kevin Castel granted the order, bringing an abrupt halt to the controversial practice of arresting non-criminal individuals inside and around New York City immigration courts.

USCIS just expanded its authority to deny or reject immigration applications because of signature issues even after the case has already been accepted and receipted. Under a new DHS temporary final rule effective July 10, 2026, USCIS may later determine that a signature was invalid and either reject the filing or deny the case entirely.

The rule targets issues such as copy-pasted signatures, signature images inserted into PDFs, signatures placed by someone other than the applicant, and unauthorized electronic signatures. USCIS clarified that scanned copies are still acceptable if the original document was genuinely signed by hand first. The concern is not the copy itself, it is whether the signature was authentic on the original filing.

This means a receipt notice should no longer be viewed as confirmation that the filing was properly executed. If USCIS later finds a signature defect, the agency may keep the filing fee and deny the case after months or even years of processing. This is especially important in filings involving deadlines, visa quotas, pending status protections, and age-sensitive benefits.
