🌟 **Attention Parents!** 🌟

I recently had a friend share an exciting moment with me. She and her husband were preparing for their first trip away on a plane without their kids. My first thought was, "How awesome! I’m jealous! Enjoy yourselves!" But immediately, I found myself asking, "Do you have your estate planning in order? Is there a legal guardian named for your kids?"

To my surprise, she admitted they hadn't done any estate planning yet. I urged her to take care of it before they left.

Many of us put it off or think we're too young to start estate planning. But if you have children, it's never too early to begin. You must be prepared for the unthinkable. At the very least, have your affairs in order so a guardian is named for your children in case anything happens.

As an estate planning attorney, I often get asked: "Should I add my adult child to my bank accounts?" Let's dive into this important question and what it means for you and your family.

1. **Can my child steal the money from my account?**
- **Yes.** If this is a concern, do not make your child an authorized signer or owner on your account.

2. **Can creditors or an ex-spouse take the money if my child gets sued or divorced?**
- It depends on the state and whether or not the funds have been commingled.

3. **What happens when I pass away?**
- If you have only one child, things may go smoothly. However, if you have multiple children, your wishes for that account should be clearly outlined in your estate planning documents.

**Payable on Death (POD) accounts** are a common solution but not foolproof. POD accounts won’t give your child immediate access to funds for funeral bills and won’t go into affect if you become incapacitated.

**My suggestion:** Have a valid Power of Attorney (POA) and tailored estate planning documents that reflect your wishes and make sense for your goals and family dynamics.

In New York, a handwritten will, also known as a "holographic" will, is typically only considered valid if it's written by:
1. Members of the armed forces while in active service.
2. A person who is accompanying the armed forces as part of their job.
3. A mariner while at sea.

These wills remain valid for one year after the end of military service or the mariner’s journey, unless the person passes away within that time.

For everyone else, a handwritten will without witnesses might not hold up in court. It's crucial to ensure your will is properly witnessed and meets all legal requirements to truly safeguard your wishes.
