When the snow falls, accidents rise.

A winter storm can turn everyday routines into serious hazards: icy sidewalks, unplowed streets, hidden black ice, and poor visibility all increase the risk of slip-and-falls, vehicle collisions, and pedestrian injuries.

Property owners and municipalities have a responsibility to maintain safe conditions. Drivers have a duty to adjust to weather. And when those responsibilities aren’t met, injuries happen.

If you or someone you love is hurt due to unsafe winter conditions, document everything:
• Take photos immediately
• Report hazardous conditions
• Seek medical attention
• Speak with an attorney before speaking to insurance companies

Stay safe. Move cautiously. And know your rights.

❄️ NYC winter storms are brutal, but your landlord’s legal responsibilities are crystal clear. They MUST maintain a safe and habitable environment.

Here are the top 3 things your landlord is legally required to do during severe weather:

1️⃣ Clear Snow & Ice: Property owners must clear sidewalks quickly after snow stops falling (sometimes within just 4 hours!) and clear a path at least 4 feet wide.

2️⃣ Maintain Heat & Hot Water: By law, your apartment must be at least 68°F during the day and 62°F at night. Hot water is a 24/7 right.

3️⃣ Keep Common Areas Safe: Wet, slippery lobbies and unaddressed storm damage aren’t just annoying, they’re negligent.

If your landlord cuts corners on safety and you get injured, they can be held liable. Know your rights and don’t pay the price for their negligence. ⚖️

⚠️ EXTREME COLD NOTICE
KNOW YOUR RIGHTS AS A TENANT

Frigid temperatures are returning to New York City this weekend, with wind chills dropping into the single digits and below zero.

NYC landlords are legally required to provide heat.

Under NYC law, landlords must maintain heat during Heat Season:

• Daytime (6:00 AM – 10:00 PM):
Minimum 68°F when the outdoor temperature is below 55°F
• Nighttime (10:00 PM – 6:00 AM):
Minimum 62°F at all times

If your apartment is without heat or falls below these temperatures:

• Report the issue by calling 311
• If the problem is not resolved, you may have legal remedies

For legal guidance regarding tenant rights and heat violations, contact us at The Ashley Law Firm.

New DMV regulations significantly increase point penalties for certain traffic violations. Two offenses that previously carried zero points will now result in 11 points.

This change goes beyond a simple point increase. Higher point values can trigger DMV action more quickly and result in substantial Driver Responsibility Assessment Fees (DRAF).

An 11-point conviction carries a $675 DRAF fee, even for drivers with otherwise clean records. Any additional points within a 24-month period add $75 per point.

These changes make understanding the impact of even a single violation more important than ever.

Don’t let a property owner’s “forgotten” shovel ruin your winter. ❄️🚫

Fresh snow looks great on a postcard, but on a sidewalk, it’s often a mask for dangerous patches of ice. If a business or homeowner fails to clear their walkways, they aren’t just being lazy, they’re being negligent.

If you’ve taken a hard fall this week, here is your Winter Injury Checklist:

1. Snap a Photo: Before the sun comes out or the salt goes down, document the hazard.
2. Identify Witnesses: Did anyone see you fall? Get their contact info.
3. Seek Medical Care: Adrenaline can mask serious injuries like concussions or hairline fractures. Get checked out immediately.
4. Know Your Rights: You shouldn’t have to pay for someone else’s failure to maintain their property.

Injured on the ice? We’re the experts at helping you get back on your feet, literally and financially.
