Just before jury selection, Wingate, Russotti, Shapiro, Moses & Halperin, LLP attorneys Erin Hurley and Thomas Brennan reached a settlement of $2,515,000 for our Brazilian client who was injured when he tripped on a two by four piece of wood sticking out from a large debris pile while he was carrying a sheet of plywood.

Earlier in the litigation, Erin's motion for summary judgment was granted. Our client had meniscus tears in both knees, which required arthroscopic surgeries, a torn cartilage in his shoulder, for which he received arthroscopic surgery, and bulging lumbar discs, which were addressed with conservative treatment.

Hoffman obtained a settlement in the amount of $3,150,000.00 for a 33-year-old demolition worker who was injured in a construction accident when he was caused to fall approximately 8 feet from an unsecured metal A-Frame ladder. The Plaintiff was preparing to dismantle and remove a segment of overhead ductwork when a portion of the ductwork fell from overhead and struck him, causing the Plaintiff and ladder to fall to the ground.

David made a motion for summary judgment regarding liability, which was granted by the Court. As a result of this accident, the plaintiff suffered serious injuries to his neck, lower back, head, shoulder, and knee, which required lumbar spinal surgery and arthroscopic procedures to the shoulder and knee. David managed to successfully resolve this matter at a mediation before the time of trial.

Wingate, Russotti, Shapiro, Moses & Halperin, LLP attorneys Ross Barbour and Konstantin Burshteyn settled a construction accident case for $3,150,000 at pre-trial mediation. The plaintiff, a union plumber, slipped and fell on a wet staircase while accessing a jobsite and injured his lower back.

The plaintiff continued working through the pain for approximately six months before eventually seeking medical treatment and undergoing emergency spinal fusion surgery. Ross and Konstantin were able to argue that despite this being a permanent staircase, it was still a gravity-related hazard, which warranted absolute liability to the premises owner under Labor Law Section 240(1).

As a result of the accident, the plaintiff ultimately underwent an amputation of the left index finger at the PIP joint as well as a cervical fusion. Michael was also able to win summary judgment pursuant to Labor Law 240(1) by demonstrating through testimony and project documents that the trench lacked proper sheeting and shoring, which directly contributed to its collapse.

Attorney Michael Zisser recently obtained a settlement of $4,400,000 for a 46-year-old union carpenter who was injured when he was struck by a falling metal beam at a construction site in Hudson Yards. As a result of the accident, plaintiff underwent extensive treatment for a head injury (which we argued constituted a traumatic brain injury), and also underwent surgery to his shoulder and neck, which defendants disputed were related to the accident. We presented significant medical evidence to contradict their defenses regarding medical causation. Michael was also able to win summary judgment pursuant to Labor Law 240(1) by demonstrating that the metal beam was not properly secured prior to falling several feet and striking him.
