A DUI may seem like a minor criminal offense in state court, but immigration authorities often evaluate these cases very differently.

For many immigrants, the biggest misunderstanding is believing that one DUI automatically leads to deportation โ€” or believing it has no immigration consequences at all. The reality is much more nuanced.

In many cases, a single DUI alone may not automatically:
โ€ข Result in deportation
โ€ข Prevent a green card approval
โ€ข Deny citizenship

However, USCIS can still carefully review the circumstances surrounding the arrest and conviction, especially in cases involving:
โš ๏ธ Multiple DUIs
โš ๏ธ Repeat alcohol-related incidents
โš ๏ธ Injuries or accidents
โš ๏ธ Drug-related DUIs
โš ๏ธ High BAC levels
โš ๏ธ Evidence of alcohol abuse or dependency

The new AOS policy memo has created enormous fear for people with pending cases โ€” especially applicants with upcoming interviews who suddenly feel like the rules changed in the middle of the process.

And for many people, that is exactly what happened.

Many individuals filed under one understanding of the law and are now facing a new policy interpretation that may push applicants to leave the U.S. and complete immigrant visa processing abroad.

But here is what people need to understand immediately:

A POLICY MEMO IS NOT AN AUTOMATIC DENIAL.

And it does NOT mean there are no remaining legal options.

What it DOES mean is that applicants now need to become far more strategic and prepared in how they present their cases.

For many applicants, this means reevaluating:
โ€ข whether stronger evidence should be submitted
โ€ข whether hardship claims need deeper documentation
โ€ข whether extraordinary circumstances can be explained more clearly
โ€ข whether the legal strategy itself needs to change before the interview

Many people may now need to prove why their adjustment should still happen INSIDE the U.S. despite the new policy environment.

That means building a stronger record showing:
โ€ข family ties to America
โ€ข U.S. citizen or green card holder relatives
โ€ข dependent children
