$2,750,000 TRIP AND FALL SETTLEMENT

Pazer, Epstein, Jaffe, Fein & Gozenput, P.C. is proud to announce a $2,750,000 settlement obtained on behalf of a client who sustained devastating orthopedic injuries as a result of a dangerous and defective roadway condition near an active utility work site in New York City.

Following the incident, our client suffered severe injuries to her ankle that ultimately required multiple surgical procedures over the course of several years, including internal fixation surgery, hardware removal procedures, arthroscopic intervention and ultimately a total ankle replacement. The injuries caused significant pain, mobility limitations and permanent effects on her daily life and independence.

Through extensive litigation, deposition testimony and discovery, our firm developed substantial evidence concerning the hazardous roadway condition and the responsibility for maintaining the area in a reasonably safe condition. The matter was ultimately resolved at mediation prior to trial by partner Eugene Gozenput. Partner Matthew J. Fein handled the depositions and discovery proceedings throughout the litigation.

TRAGIC NYC FATALITY AFTER WOMAN FALLS INTO UNCOVERED MANHOLE

A heartbreaking tragedy occurred Monday night in Midtown Manhattan when a 56-year-old woman lost her life after falling into an uncovered manhole shortly after exiting her vehicle. According to reports, the victim fell approximately 10 feet into the open utility hole before emergency responders arrived at the scene.

Despite the efforts of bystanders and first responders, the woman later succumbed to her injuries at the hospital. Authorities are actively investigating how the manhole was left uncovered and whether proper safety measures were in place to prevent such a devastating incident.

This tragedy serves as a stark reminder of the serious dangers posed by unsafe conditions on New York City streets and sidewalks. Property owners, contractors, utility companies, and municipalities all have a responsibility to ensure that hazardous conditions are properly secured to protect the public.

Our thoughts and deepest condolences are with the victim’s family and loved ones during this incredibly difficult time.

CONSTRUCTION SETTLEMENT: $5,000,000

Our firm is proud to announce a $5,000,000 settlement in a construction accident case on behalf of a hardworking New York construction worker. Our client, a 35-year-old electrician, was seriously injured when a ten-foot deep trench collapsed beneath him, causing him to fall and sustain significant injuries. He had been directed to work under dangerous conditions, which put him in harm’s way next to the trench, which was not properly shored or braced.

In motion practice, defendants inaccurately argued our client could have been responsible for causing his own accident, but we succeeded in holding defendants fully liable in argument before the Appellate Division.

As a result of the incident, our client suffered severe physical trauma that required extensive medical treatment and impacted his ability to work. As this matter was approaching trial, partners Eugene Gozenput and Matthew J. Fein were able to negotiate a settlement in the amount of $5,000,000.00.

RUBBLE FALLS FROM LOWER MANHATTAN NYC BUILDING

A section of facade reportedly fell from a Lower Manhattan building under repair Monday morning, sending debris into the street near the Department of Buildings headquarters. Thankfully, no serious injuries were initially reported, though the incident prompted an emergency response and street closures. We are relieved no one was badly hurt, and hope city officials fully investigate how this dangerous incident occurred.
