Partner Matthew Fein and Associate Brett Perlstein successfully argued for summary judgment before the Supreme Court, New York County, on behalf of our client, a hotel banquet server who was severely injured when he was caused to step onto an unsecured and unattached step.

The step—leading to an event stage where he worked—flipped over beneath him, causing him to crash to the ground. Through extensive depositions and with the assistance of an expert opinion, Matthew and Brett established that the step being used was not designed or compatible for use with the stage and that an appropriate step should have been firmly secured to prevent it from shifting or moving under a worker’s weight. The Court granted summary judgment in favor of our client.

LI Construction Worker Dies After Water Main Break

Sadly, a 56-year-old construction worker was killed last week while working underground near Roosevelt Field in Uniondale. Reports say the worker tragically drowned after a water main break flooded the work area.

Our heartfelt condolences go out to the worker’s family, loved ones, and coworkers during this incredibly painful time.

Detectives say the worker had been working underground, when water from a broken main submerged the area. His coworkers pulled him out, and saving measures were performed.

NYC Council Considers 23 Proposals to Improve E-Bike & Scooter Safety

The New York City Council is considering 23 proposals to improve safety for pedestrians, cyclists, delivery workers, and other New Yorkers as e-bike and scooter collisions continue to rise. The proposals include stronger enforcement, additional safety measures, and greater accountability for delivery services and unsafe devices.

The City Council held a hearing Wednesday on the proposals following a series of fatal collisions.

OSHA Announces $10.2 Million in Worker Safety Grants

OSHA is investing approximately $10.2 million in worker safety through grants to 67 organizations nationwide. The funding will support safety and health training focused on hazard awareness, prevention, and controls. Investments like these can help give workers the knowledge and tools they need to recognize and avoid dangerous conditions on the job.

$1.4 MILLION CONSTRUCTION SETTLEMENT

Our team is proud to announce another successful result for an injured construction worker.

Our client, a carpenter working on a major commercial construction project, was seriously injured when a large rolling scaffold became unstable as it was being moved. A wheel detached from the scaffold, causing it to suddenly tilt. In an effort to prevent the heavy scaffold from falling, our client instinctively reached out to stabilize it, suffering a severe shoulder injury that ultimately required surgery.

Our firm fought to establish that the construction site failed to provide proper safety protections required under New York Labor Law and obtained Summary Judgment on liability after extensive motion practice. After aggressively litigating the case, we secured a $1,400,000 settlement prior to trial on behalf of our client.

Construction workers should never have to risk their safety because of defective equipment or unsafe jobsite conditions. We are proud to fight for injured workers and hold negligent owners and contractors accountable.
