Itโ€™s now illegal for a landlord to ask for a deposit of more than one month of rent under New York State law. Also, an owner must keep the deposit in a separate bank from their personal funds. Once the tenant vacates the apartment, the landlord is required to reimburse the deposit within 14 days.

New York tenants are legally entitled to a livable and safe apartment. The legal term for this is the Warranty of Habitability.

Some of the common Warranty of Habitability conditions that New York tenants may experience include but are not limited to: Lack of heat or inadequate heat, lack of hot water, plumbing issues, pest infestations, bedbugs, broken appliances, missing or broken smoke/carbon monoxide detectors, etc.
If your apartment becomes damaged and uninhabitable due to fire, water damage, hurricane, or another natural disaster, etc., then you may have the right to cancel your lease upon written notice. In that event, you would have no further obligation to pay rent or finish your lease, provided that you vacate and surrender the premises.
