Fashion Law Watch: Rolex Faces €91.6 Million Fine for Online Sales Ban
The French Competition Authority has fined Rolex €91.6 million ($99.9 million) for prohibiting authorized retailers in France from selling its watches online for over a decade. Following a seven-year investigation triggered by a French retailer’s complaint, the authority ruled that Rolex’s ban on online sales unfairly restricted competition and limited consumer access.
Rolex argued the ban was necessary to combat counterfeiting and out-of-network sales, but the authority noted that competitors address these risks through technology while allowing online distribution.
The decision also highlighted Rolex’s Certified Pre-Owned program, which supports online sales of pre-owned watches, further undermining its justification.
The fine applies to Rolex France and related entities, which have two months to appeal. Alongside the fine, Rolex must publish the decision summary across multiple platforms, including its website and major French publications.
💭 Questions to Consider:
* Should luxury brands adapt to online sales to meet consumer expectations, or do traditional models better protect exclusivity?
* How can companies balance combating counterfeiting while maintaining fair competition?
* Will this decision set a precedent for other luxury brands operating in similar ways?
