On March 10, Sher Tremonte LLP secured a complete victory after a three-week jury trial in the Nassau County Commercial Division.

The firm represented two investors accused of fraud and other misconduct related to an overseas fertilizer business. After dismissing all but one of the plaintiffs’ claims pretrial, the jury rejected the sole remaining fraud claim in full and returning a verdict for both clients after less than a day of deliberations.

Sher Tremonte LLP is pleased to share a recent victory on behalf of our client, Elumeo SE, a German online and TV jewelry retailer.

In the U.S. District Court for the Northern District of Georgia, the Court granted Elumeo’s motion to dismiss all claims brought by Kat Florence, LLC and Don Kogen, dismissing the case for lack of subject matter (alienage) jurisdiction under 28 U.S.C. § 1332. The Court agreed with Elumeo’s factual challenge to jurisdiction under Rule 12(b)(1) of the Federal Rules of Civil Procedure, finding that Kat Florence failed to prove that it was a citizen of any U.S. state at the time the complaint was filed.

This result underscores our team’s focus on front end, jurisdictional and procedural defenses that can resolve complex cross border business disputes efficiently and decisively.

On February 19, 2026, Sher Tremonte LLP filed an amicus curiae brief in the Supreme Court on behalf of 216 Members of Congress in Trump v. Barbara, No. 25-365, a case challenging the Administration’s attempt to restrict birthright citizenship by executive order.

The Members—drawn from both chambers and key committees with jurisdiction over immigration and homeland security—urge the Court to hold that the Executive Order is invalid because it conflicts with Congress’s explicit mandate in 8 USC § 1401(a). The brief explains that, for more than eight decades, federal immigration statutes have guaranteed citizenship to virtually all persons born in the United States under the jus soli rule, and that the structure of the modern INA depends on that statutory guarantee.

On February 9, 2026, Sher Tremonte LLP filed a proposed amicus curiae brief in the District of Columbia Court of Appeals on behalf of the National Association of Criminal Defense Lawyers (NACDL) in support of a petition for a writ of mandamus in In re Meta Platforms, Inc. and Instagram, LLC, No. 26-OA-0001. The amicus brief urges the Court to grant mandamus to vacate a D.C. Superior Court ruling that applied the crime-fraud exception to communications between Meta and its in-house counsel.
Sher Tremonte represented NACDL together with co-counsel Kobie Flowers of Flowers Keller LLP. The Sher Tremonte team on the filing included partners Michael Tremonte and Noam Biale, associates Rebecca Prager and Eleuthera Sa, and paralegal Anand Chitnis.

The U.S. Court of Appeals for the Second Circuit largely affirmed a nearly $88 million in total damages awarded to Alta and co-plaintiff by the Southern District of New York against Getty Images Holdings, Inc. The ruling upholds the district court’s core findings that Alta was entitled to exercise its warrants and that Getty breached its contractual obligations by blocking those exercises.

“We are very pleased that the Second Circuit affirmed the district court and agreed that Alta was entitled to exercise its warrants,” partner Justin M. Sher, who argued the appeal, told . “The decision sends an important message that issuers must honor their commitments to investors.”
