This week’s term: Request for Evidence (RFE) 📄🇺🇸

Receiving a Request for Evidence (RFE) means that U.S. Citizenship and Immigration Services (USCIS) is asking for additional information or documents before making a decision on your immigration case.

An RFE can be issued when USCIS needs more evidence to determine whether you qualify for the benefit you applied for.

If you receive an RFE, it’s important to carefully review what USCIS is requesting and submit your response by the deadline listed in the notice.

The documents and information needed will depend on your specific case.

The O-1 has no lottery. No degree requirement. No annual cap.

Just one hard question: can you prove you’re extraordinary in your field?

That word does a lot of work, and USCIS interprets it narrowly. Two equally accomplished professionals can file nearly identical evidence and get very different outcomes, because approval isn’t just about what you’ve achieved. It’s about how clearly that achievement is connected, documented, and argued.

Awards, media coverage, high salary, leadership roles: these all matter, but only when they’re framed as part of one coherent case, not a list of accomplishments.

If you’re considering the O-1, understanding what “extraordinary” actually means to an adjudicator, before you file, changes everything. Full breakdown in the comments. 👇

Building a business is important, but so is making room for the moments that make you smile.

And for the record, I only had one bite.

This week’s term: Adjustment of Status

It sounds straightforward , apply for your Green Card without leaving the U.S. But whether you actually qualify depends on your visa category, availability, and honestly, the specific details of your case. That’s usually where things get complicated.

We see this a lot: someone assumes they’re eligible, files on their own timeline, and finds out too late that a detail they overlooked changes everything.

If you’re wondering where you stand, that’s exactly the kind of question worth asking before you file , not after.

Here’s a question we get a lot: “Do I need to adopt my stepchild for them to immigrate?”

The short answer: Not always. It depends on your relationship and how the child entered your life.

Adoption is usually required when:
⚠️ You married the child’s parent after the child turned 18
⚠️ The child entered the U.S. on a visa and didn’t become your stepchild until after turning 18
⚠️ The marriage that created the stepchild relationship happened after the child turned 18

Every family’s situation is different, and getting this wrong can cost you time and money. Review your case carefully and reach out to us with any questions

Your 2-year Green Card isn’t the finish line. It’s a checkpoint.

If you obtained permanent residence through marriage less than two years in, USCIS gives you conditional status, not the full 10-year card. To convert it, you have to file Form I-751 within a strict 90-day window before it expires. File too early, and it’s rejected. Miss the window entirely, and your status can terminate automatically.

The good news: this step isn’t about re-proving your entire case. It’s narrower than that; USCIS is focused on one question: is your marriage still genuine? But narrow doesn’t mean simple. The evidence, the timing, and how you present your case all matter.

Whether you’re filing jointly, navigating a divorce, or handling a more complex situation, understanding this window early gives you room to prepare instead of scramble.
