특별히 학교, 사업, 가족과의 만남 등을 위해 일정 기간이 필요한 분들은 고민이 크실텐데요, 미국과 비자면제 협정국인 한국인이 미국 내 90일 까지 체류가 가능한 방문비자 발급을 위해 전문가의 조언을 들어봤습니다.

비자 면제 프로그램으로 미국에 입국하면 통상 90일까지 미국에 체류할 수 있으나, 무비자 입국시에는 미국 시민권자의 직계 가족으로 영주권을 신청하는 경우를 제외하고는 어떤 신분 변경도 체류기간 연장도 미국내에서 신청할 수 없습니다.
남창희 변호사는 “방문 비자로 미국내 입국시 최장 180일까지 체류할 수 있으며, 필요시 체류기간을 연장 하거나 학생 신분 등으로 신분 변경을 신청할 수 있다”고 말했습니다.
이어 “따라서 많은 한국인들이 방문 비자를 발급 받아 미국에 입국하기를 희망한다”며 “방문 비자 심사기준 가운데 비자 신청자가 방문 비자의 용무가 끝난 뒤 미국에 불법 체류하지 않고 반드시 바로 미국을 떠날 것인가 라는 확신을 인터뷰시 영사에게 주어야 한다”고 강조했습니다.

US District Court Judge Andrew Hanen of Texas has issued a temporary injunction barring the expanded DACA program (Deferred Action for Childhood Arrivals). The Obama Administration will be appealing the decision, but will comply with the temporary injunction.

What this means is that the original date (February 18, 2015) of accepting applications for the expanded DACA will be delayed until the matter is resolved in the courts.

The DACA (Deferred Action for Childhood Arrivals) program was expanded by executive (Presidential) action and will begin accepting applications on February 18, 2015. The expanded DACA is not considered amnesty, but rather defers removal action by the US government for three years.

Eligibility requirements for the expanded DACA include all of the following:

(1) Entered the US before the age of 16.
(2) Continuously lived in the US since January 1, 2010.
(3) Currently in school, or graduated high school, or received a GED, or was honorably discharged from the US military forces or US Coast Guard.
(4) Have not committed a felony, a significant misdemeanor or three lesser misdemeanors.

Documentation of proof for these eligibility requirements must be provided when applying for the expanded DACA.

FATCA - Foreign Account Tax Compliance Act - requires US taxpayers to disclose their foreign assets such as bank accounts. To date,145,000 foreign financial institutions have registered and the IRS has made 110 intergovernmental agreements in order to find out about US taxpayer assets in foreign banks. Without proper reporting and filing, US taxpayers with foreign assets may face large penalties.

Financial institutions and host country tax authorities will use the International Data Exchange Service to provide the IRS with information on financial accounts held by Americans.

버락 오바마 대통령이 백악관에서 특별연설을 통해 이민개혁 행정명령을 발표했습니다.

이번 특별연설에서 행정명령 구제 혜택을 받는 대상자는 , 미국 시민권자나 영주권자 자녀를 두신 불체자 부모님에게 3년간 합법적으로 거주하며 노동허가증 (워크 퍼밋)을 발급해줍니다. ( DAPA)

대상자들은 2010년 1월 1일 이후 계속해서 미국에 거주했어야 하고 중범죄 전과기록이 없어야 합니다.

2012년 실시한 DACA (청소년 추방유예)로 6십만명이 추방유예 헤텍을 받았습니다, 2012 기준으로 나이 기준으로 나이가 30세 이하 연령 제한이 있었으나 이번 행정명령에서는 30세 라는 연령제한을 없애 혜택을 못받은 사람들도 이번에 구제 대상에 포함되어 수혜폭을 넓혔습니다.

또한, DACA는 추방유예 기간이 2년이었고 2년마다 연장할 수 있도록 했었는데, 이번 추방유예 기간은 3년으로 늘어납니다. 이로인해 3십만명이 추가로 추방유예 혜택을 보게 되리라 예상됩니다.

이번 구제 대상에 포함안된 서류미비자들은!

첫째, 추방유예 혜택을 받은 청소년들의 부모는 제외됩니다. 그러나 이들에 대한 추방이 가속화되지는 않을겁니다.그리고

두 번째, 이번 추방유예 명령 후 중범을 저지른 이민자의 추방은 강화될 것으로 보이고, 세번째, 농업 분야의 서류미비자들도 이번 추방 유예 혜택에 포함되지 않았습니다.
