The repeal of 50(a), which will expose police abuses and treat law enforcement officials like all other public servants, is one part of a sweeping criminal justice reform package, which includes bills that prohibit police chokeholds, mandates additional transparency, reporting and oversight of law enforcement and creates new civil rights causes of action for interference with recording police interactions, limiting detainee access to medical attention and for false reporting against a member of a protected class

Governor Andrew Cuomo vetoed legislation today that would have eliminated an inequity in the law that allows a responsible party to avoid paying a judgment by using another responsible party as a shield. The legislation would have allowed a plaintiff, who had already received a favorable jury verdict against multiple responsible parties, to recover directly from all those responsible parties. Presently a third-party defendant is able to shirk its obligation to pay damages because by operation of law, a victim, even after a favorable verdict, cannot bring a claim against such third-party defendant.

Governor Cuomo has signed a technical chapter amendment that allows satellite-mapping services, such as Google Maps, to be admitted into evidence at trial. The legislation and the chapter amendment, will further the interests of justice by expanding the court’s access to critical information in an efficient and modern way. The law took effect immediately and is retroactive to December 28, 2018.

This statute relieves a litigant of their obligation to call an expert witness to authenticate the validity of an image or calculation generated by Google Maps or a similar web-mapping service. Judicial notice is taken of Google Maps in federal court, as a source that "can be accurately and readily determined from sources whose accuracy cannot reasonably be questioned" pursuant to Rule 201 of the Federal Rules of Evidence. This change to the CPLR will allow litigation to proceed in a timelier manner in New York courts and will help accelerate the resolution of litigation.

Moments ago, the State Senate passed legislation that would eliminate an inequity in the law that allows a responsible party to avoid paying a judgment by using another responsible party as a shield. The legislation, S6552 sponsored by Senator James Skoufis, would allow a plaintiff to recover directly from all responsible parties who are found liable for damages. Presently a third-party defendant is able to shirk its obligation to pay damages because by operation of law, a victim cannot bring a claim against such third-party defendant.

This legislation will foster settlement of cases without the need for lengthy and costly trials and post-trial proceedings to enter judgments, easing the burden on the court system and reducing litigation costs for all parties.

Progress is being made in the fight to modernize New York’s antiquated wrongful death statute. The Assembly Codes Committee voted to advance legislation that would reform New York’s antiquated wrongful death statute with bipartisan support by a vote of 21-1.
The proposed legislation, Senate Bill S4006 by Senator Brad Hoylman and Assembly Bill A5612 by Assemblymember Helene Weinstein, would reform New York’s wrongful death statute, which has not been updated since its implementation in 1847. The current law limits wrongful death damages to “pecuniary” loss, which wrongly places more value on the lives of high wage earners over those of retirees, disabled individuals, children, and stay at home parents. We look forward to hearing progress from the State Assembly .
