Kevin Lee and Rikki Dascal obtained a plaintiff’s verdict and $800,000.00 award against NYC Health + Hospitals on behalf of a 23-year-old woman who tragically died due to a hospital’s failure to properly treat her after she presented to the Emergency Room. The jury deliberated for just 1 hour and 44 minutes before returning to the courtroom to render the verdict.

As Rikki Dascal stated in her closing statement to the jury, “This trial is your opportunity to hold a hospital in your community to the same standard of care as any other hospital in New York City. Regardless of which hospital our client walked into, she should have received the same level of care.”

This important verdict affirms that all patients deserve equal access to high-quality health care regardless of differences in race, gender, class, or language.

Rikki Dascal, Esq. represented a Rikers Island detainee who tragically mutilated both of his eyes while in distress, resulting in permanent blindness. Rikki alleged that Rikers Island personnel failed to properly attend to our client, leaving him in an extremely vulnerable state despite the fact that he displayed clear warning signs indicating that he was in need of help.

Last Wednesday, the Jacob Fuchsberg Law Firm proudly hosted a Black History Month Reception in collaboration with the NYS Academy of Trial Lawyers! We were honored to welcome special guests Hon. Genine Edwards, Hon. Kathy King, distinguished attorney Esmeralda Simmons, Esq., and singer Natalie Douglas!

The program celebrated the legacy of Black attorneys and advocates who have helped advance inclusion in the legal profession, while simultaneously acknowledging the systemic barriers that continue to restrict underrepresented minorities from accessing the field. Our speakers shared powerful reflections on their personal journeys as Black leaders in the legal field and their commitment to opening doors for the next generation.

On the last day of trial, Eli Fuchsberg and Emma Klein successfully settled a complicated case involving a mother who tragically developed stage four lung cancer due to her primary care doctor’s failure to work up her persistent symptoms of recurrent cough and chest pain over a four-year period. The client was overjoyed with Mr. Fuchsberg and Ms. Klein’s thorough presentation of her case.

This week, former Queens urgent care doctor, Amir Sitafalwalla, was sentenced for sexually abusing five patients. Hardeep Shergill, Esq. was present at the sentencing in support of our victims who continue to suffer from devastating impacts of Sitafalwalla’s abuse.

Sitafalwalla was arrested twice for complaints of sexually abusing patients, and his medical license was suspended following an investigation performed by the Department of Health. In October 2025, Sitafalwalla pled guilty to five counts of forcible touching as to four different victims, and one count of sexual abuse in the third degree as to one additional victim.

Our attorneys Jae Oh, Esq. and Hardeep Shergill, Esq. have filed civil lawsuits against ModernMD Urgent Care and Sitafalwalla for their failure to protect patients from his abuse despite prior indications of Sitafalwalla’s abusive tendencies.
