Bridgewater lawyer Rajeh A. Saadeh sued the New Jersey State Bar Association's over its policy of reserving leadership positions for members of minority groups.

Saadeh's petition to the U.S. Supreme Court argues the question presented in the case is "Whether the First Amendment overrides anti-discrimination laws when the discrimination furthers the defendant’s views about diversity, equity or inclusion.”

"Illegal discrimination does not become a constitutional right when the discriminator discriminates in the name of diversity," Saadeh's petition says.

NJSBA is represented on the case by Lawrence Lustberg of FBT Gibbons. Saadeh petitioned for certiorari with assistance from with lawyers from the George Mason University Antonin Scalia Law School's Supreme Court Clinic and law firm Consovoy McCarthy.
