According to section 10 of Punjab Partition Act 2012 if the parties ( legal heirs of the property ) do not reach any agreement and the immovable property is not partible the court will order for INTERNAL AUCTION between relevant parties to the suit of the immovable property in the court.
If it fails due to any reason this process will be repeated again. If again it fails, only then the court will order for OPEN AUTION of this property under section 11 of this Act.
Meaning thereby Open auction of the disputed property in suit for partion of property within legal heirs can not be held stateway at the first hand.
