🚨 BREAKING: A federal court just struck down the $100,000 H-1B fee.

Today, Judge Sorokin of the U.S. District Court for Massachusetts ruled that Trump’s Proclamation 10973, which added a $100,000 payment requirement to every new H-1B visa petition, is unlawful.

The court found the fee is an unconstitutional tax that Congress never authorized. Summary judgment was granted for the plaintiff states on all four counts:

❌ Unconstitutional tax (separation of powers violation)
❌ No notice-and-comment rulemaking
❌ Exceeded statutory authority under the INA
❌ Arbitrary and capricious agency action

The entire policy has been vacated nationwide.

Before this Proclamation, H-1B filing fees ranged from $960 to $7,595. The $100,000 fee made it nearly impossible for schools, hospitals, and universities to hire the workers they need.

That barrier is now gone.

Somewhere in this great land of ours, a mother still sets an empty place at the table. A father still looks at the door, half-expecting to hear the footsteps that will never come home. A child grows up knowing their hero only through photographs, letters, and the quiet pride of a folded flag.

They were not just soldiers, sailors, airmen, and Marines. They were the silent warriors in the shadows, the unnamed operators who carried out missions the world will never know about, in places that will never appear on any map. They served not for glory, not for recognition, but because they believed, as we all must believe, that freedom is worth defending. 🫡

🦅 Freedom is never more than one generation away from extinction. It is not passed down through the bloodstream. It must be fought for, protected, and handed on for our children to do the same. The men and women we honor today understood that truth better than anyone.

A new policy memo (PM-602-0199) issued May 21, 2026 now tells officers to treat adjustment of status as “extraordinary relief” and a matter of “administrative grace.”

Translation? Getting your green card inside the U.S. just got a lot harder. 👇

❌ Meeting all eligibility requirements no longer guarantees approval

❌ Overstays, unauthorized work, and status violations are weighed more heavily than ever

❌ You now need to prove “unusual or outstanding equities” to overcome any negatives

❌ USCIS is pushing consular processing as the “normal” route

The “End H-1B Visa Abuse Act of 2026” proposes:

⏸️ A 3-year PAUSE on all new H-1B visas
📉 Slashing the annual cap from 65,000 to just 25,000
💰 A $200,000 minimum salary requirement
🔒 Banning third-party staffing firms from sponsoring H-1Bs
❌ Ending OPT and blocking adjustment to permanent residence

🚨 DHS Did Not Show Up to Court. The Judge Dismissed the Case. The BIA Just Reversed It.

📅 On April 23, 2026, the Acting Attorney General designated Matter of Arana Castillo, 29 I&N Dec. 593 (BIA 2026), as a binding precedent decision. This changes the rules for every respondent in removal proceedings.

⚖️ Here is what you need to know:

1️⃣ When DHS fails to appear at your master calendar hearing, the Immigration Judge will no longer terminate your case.

2️⃣ Instead, the judge must take your pleadings to the Notice to Appear under 8 C.F.R. Section 1240.10.

3️⃣ If you admit the allegations and concede the charge, the judge can order you removed — even without DHS in the room.

4️⃣ If you deny the allegations or contest the charge, the judge must request DHS counsel and schedule further proceedings.

5️⃣ This decision makes legal representation more critical than ever. What you say at the pleading stage defines the trajectory of your entire case.

🛑 Do not walk into that courtroom without an attorney. Do not assume that DHS failing to appear is good news. Prepare. Know your rights. Have a plan.
