⚖️ BIA OVERRULES 14 YEARS OF ADVANCE PAROLE LAW

📜 Matter of Delcarmen-Lara, 29 I&N Dec. 830 (BIA 2026), decided August 13, 2026, overrules Arrabally and Yerrabelly (2012).

🔎 The holding: leaving the U.S. on advance parole is now a “departure” under INA 212(a)(9)(B)(i)(II).

🔄 Before, that trip did not trigger the unlawful presence bars. Now it can.

⏳ 180+ days of unlawful presence = 3 year bar. One year or more = 10 year bar. A waiver may be available.

🛑 Read this part: the ruling is PROSPECTIVE ONLY. Trips taken before August 13, 2026 are still governed by the old rule. If you already traveled, do not panic. Get it reviewed.

🧳 Pay attention before booking if you are an adjustment applicant, a DACA or TPS holder who entered without inspection or overstayed, or anyone with prior advance parole travel.

🧮 Unlawful presence is a calculation, not a guess. Have the math run before you buy the ticket.

⚠️ ONE CHECKBOX CAN END YOUR IMMIGRATION CASE. FOREVER.

📝 Every new hire in America fills out a Form I-9. Section 1 asks you to attest to your status under penalty of perjury. The very first box says “U.S. citizen.” Check it when you are not one and you may have just created a bar with no waiver.

🚨 Under INA 212(a)(6)(C)(ii), falsely claiming to be a U.S. citizen for any purpose or benefit under federal or state law makes you inadmissible. ❌ No materiality requirement. ❌ No 212(i) waiver. ❌ No hardship exception, no matter how sympathetic your family.

🗳️ And it is not only the I-9. Voter registration, passport applications, federal student aid, benefits limited to citizens, and answering “yes” to an officer at an airport can all trigger it.

⏱️ There is one real lifeline. 🛡️ A timely retraction. Board precedent treats a false statement as never made if you correct it voluntarily, before the government confronts you with contrary evidence, and at the first real opportunity. Waiting until you are caught does not count.

✅ If you were ever asked whether you are a U.S. citizen on a form, do not file anything else until a lawyer has read the record. Save every email, confirmation and cancellation notice. Proof that you fixed it before anyone questioned you is the strongest evidence in the file.

🚨 URGENT: A new rule could send nearly 450,000 asylum seekers straight to deportation court.

This week the administration put a rule into effect immediately, before the public could weigh in. USCIS can now refer pending affirmative asylum cases directly to Justice Department immigration judges. Officials say as many as 444,724 cases could be transferred, nearly a third of the 1.4 million asylum cases pending at USCIS.

Why this matters: for years, people who entered lawfully or were never charged with a violation got to present their claim to a trained asylum officer in a non adversarial interview. That interview was often the first and best chance to be heard. Under this rule, that step can disappear. Immigration judges have been empowered to dismiss certain cases without a hearing, so attorneys warn that people could be ordered removed without ever telling their story.

If you have a pending I-589, do not wait for a notice in the mail:

✅ Confirm your address is current with USCIS and EOIR
✅ Check your case status and hearing dates regularly
✅ Get your evidence and declaration court ready now
✅ Never miss a hearing date
✅ Talk to an immigration attorney about every form of relief available to you, including withholding of removal and protection under the Convention Against Torture

🚨 IRANIAN VISA BENEFICIARIES: DO NOT CANCEL YOUR INTERVIEW 🚨

Some lawyers are telling Iranian clients to cancel their visa interviews because of the travel ban. This is not strategy. This is laziness. And it could destroy your case. 👇

🔴 Interviews are STILL being scheduled and conducted at Ankara, Abu Dhabi, and Yerevan. The government wants you to show up.

🔴 A 221(g) refusal is NOT a denial. It keeps your case alive, reviewed on the merits, and ready to move the moment the ban shifts.

🔴 A 212(f) refusal is a policy-based suspension, not a finding that you are personally inadmissible. Policies change.

🔴 Under INA 203(g), if you fail to act within one year of visa availability notice, the government can TERMINATE your registration and revoke your approved petition. The U.S. Embassy in Doha is already sending termination notices for inactive cases. ⚠️

🔴 There is NO U.S. embassy in Iran. Cancel and you could wait months or years for a new interview at a third-country post. While the 203(g) clock ticks. ⏰

🔴 Waivers still exist under Proclamation 10998, but you cannot be considered if you do not show up.

✅ Attend = case stays alive, fully processed, ready to move
❌ Cancel = back of the line, 203(g) risk, no waiver path
