Big win in Kings County, the defense tried to throw the case out on summary judgment , claiming the accident was not foreseeable. I argued that when multiple inferences are possible, foreseeability remains a question of fact for a jury, going back to the seminal case on foreseeability, Palsgraf v Long Island Railroad, from the New York State Court of Appeals in 1927. Judge found my argument persuasive, and denied the defendants’ motion.

Client has an appointment at Italian consulate in NYC in early April and needed a court order to release his grandfather’s birth certificate. I proceeded by order to show cause, asked for a speedy determination of the motion, and the judge granted the motion and signed the order February 18.
