In a highly contested and controverted workers compensation case involving a gentleman from Queens, we had trial and prevailed. After direct examination of my witness, cross examination of employer witness, and summations, the judge was persuaded and sided with us. Claimant’s case is established and deemed compensable for occupational disease of : bi-lateral shoulders , hips, knees , ankles, feet, and 8 fingers.

Big win in Kings County, the defense tried to throw the case out on summary judgment , claiming the accident was not foreseeable. I argued that when multiple inferences are possible, foreseeability remains a question of fact for a jury, going back to the seminal case on foreseeability, Palsgraf v Long Island Railroad, from the New York State Court of Appeals in 1927. Judge found my argument persuasive, and denied the defendants’ motion.
