Senior Trial Partner Christopher Terzian secured a unanimous appellate victory before the Appellate Division, Second Department, on behalf of MCB’s surgeon client in a case involving complications following gallstone removal surgery.

The Court reversed the Supreme Court’s denial of Summary Judgment, finding that the plaintiff’s expert opinion was speculative, unsupported by the record, and failed to establish causation.

Congratulations to Mr. Terzian on this successful result!

MCB established that the splenic artery injury was a known and accepted risk of the procedure that could occur in the absence of negligence. The Court found that the defense established its prima facie entitlement to Summary Judgment and that Plaintiff failed to rebut the defense’s arguments.
