On November 2, 2025, USCIS released Policy Alert, confirming that a grant of U nonimmigrant status inside the U.S. is not an “admission” for purposes of adjustment under INA §245(a).

This update implements the Supreme Court’s decision in Sanchez v. Mayorkas (2021) and clarifies that U visa holders must seek adjustment under INA §245(m), not §245(a), unless they were admitted at a port of entry.
