Our firm has cultivated a niche practice of representing groups of owners of newly constructed condominiums in disputes with sponsors and sponsor-controlled boards. This week, we had a great victory in New York County Supreme Court on behalf of a group of thirty one such owners in Brooklyn.

These disputes are exceptionally tricky for a number of reasons: the sponsor controls the Board and the flow of information, owners are not privy to the arrangements made between the Sponsor and its construction professionals, and the parent developer is effectively insulated from suit other than on an alter-ego basis.

All fourteen counts of our complaint -- including alter-ego claims, claims of negligence against the sponsor and their various construction professionals, and breach of fiduciary duty claims against individual sponsor-controlled board members -- survived a motion to dismiss in full, without the dismissal of a single claim or defendant.

We look forward to more successes on behalf of this group and similarly aggrieved unit owners who are fighting the admittedly uphill battle against bad acting sponsor and sponsor-controlled boards.
