What Components Make Up A Viable Product Liability Case?
You must be able to trace your injuries or other damages to a design or manufacturing defect in the product or failure to warn of the dangers involving the product's use. In New York, New York, it is the manufacturer's responsibility to manufacture products up to safety and quality standards. They must also warn consumers of any danger or risk that may result from the use of their product.
In order to prove fault in cases of this nature, it must be established that the injury or damage caused to you was the direct result of the manufacturer's defect. If the product was not defective or manufactured poorly, it must also have sufficient warning of any possible damage it is capable of causing.
