Because of changes in the 2020-2021 NY State budget, New York City HRA is changing the look back period for community Medicaid applications (home health care) from one month to 2.5 years beginning October 1, 2020. This will radically change emergency Medicaid trust planning because assets will still be considered available to the grantor for 2.5 years after being transferred to a trust.
