FBPF secured a discontinuance with prejudice for a commercial moving and storage client in New York City Civil Court, with no payment or settlement contribution from the client.

The parties also exchanged mutual releases, with protective covenants designed to provide finality and prevent the dispute from being re-agitated.

A significant result in a New York construction injury case.
FBPF, led by partner Thomas Papain, together with trial counsel Nicholas Papain of Sullivan Papain Block McManus Coffinas & Cannavo P.C., secured an $850,000 settlement for a construction worker who suffered a serious leg injury when a Baker scaffold collapsed.
After securing summary judgment on liability under Labor Law §240(1) and preparing the matter for trial, the case settled on the eve of trial.
